Welcome to AKSTARCO. These Terms & Conditions (“Terms”) apply to your use of the AKSTARCO website and to purchases, quotations, custom orders, personalized products, deliveries, pickups, and services provided by AKSTARCO (“AKSTARCO,” “we,” “us,” or “our”).
By using our website, requesting a quotation, placing an order, or purchasing our products, you agree to these Terms.
1. About AKSTARCO
AKSTARCO is a custom-design and personalized-gift business based in Durham Region, Ontario, Canada.
Our products may include:
Custom-designed shirts and apparel
Personalized mugs
Tumblers
Tote bags
Frames
Keychains
Personalized gifts
Accessories
Seasonal and event-related products
Other customized products offered by AKSTARCO
We serve both individual and organizational customers.
2. Custom and Personalized Products
Many AKSTARCO products are individually customized according to customer requirements.
Because personalized products are created specifically for each customer, the final product may differ slightly from digital previews or reference images due to:
Screen and monitor differences
Printing and material characteristics
Product texture and finish
Placement variations
Colour variations
Handmade or production processes
Reasonable variations do not necessarily constitute a defect.
3. Customer-Provided Information and Artwork
Customers may provide names, photographs, logos, artwork, text, or other materials for customization.
By submitting these materials, you confirm that you have the necessary rights, permissions, or authorization to use them.
You agree not to provide material that unlawfully infringes another person’s copyright, trademark, privacy, publicity, or other rights.
AKSTARCO reserves the right to decline an order where the requested content may create legal, safety, or ethical concerns.
4. Design Approval
For customized orders, AKSTARCO may provide a design preview or request confirmation of personalization details before production.
Customers are responsible for carefully reviewing names, spelling, dates, wording, colours, quantities, sizes, and other details before approving a design.
Once a personalized design has been approved and production has started, changes may not be possible.
AKSTARCO is not responsible for customer-approved errors in spelling, wording, names, dates, images, or other customization details.
5. Quotations and Pricing
Quotes provided by AKSTARCO may depend on the product, quantity, materials, customization requirements, design complexity, delivery or pickup arrangements, and production requirements.
Unless otherwise stated, quotations are subject to change until the order is confirmed.
Special pricing, bulk pricing, corporate pricing, or organizational pricing may be available depending on quantity and requirements.
AKSTARCO may offer competitive or discounted pricing for organizations, events, and bulk orders.
6. Orders and Payment
An order is considered confirmed when AKSTARCO has received the required order information and any required payment or deposit.
Payment requirements may vary depending on the type, size, or value of the order.
AKSTARCO may require full payment or a deposit before beginning production, particularly for custom or large orders.
Production timelines may begin only after all required information, artwork, approvals, and payments have been received.
7. Changes and Cancellations
Because custom products are made specifically for individual customers, cancellation or modification may not be possible once production has begun.
If you need to change or cancel an order, please contact AKSTARCO as soon as possible.
If production has not started, AKSTARCO may, at its discretion, allow changes or cancellation.
Any refund or cancellation amount will depend on the stage of production and costs already incurred.
8. Returns and Refunds
Because personalized and customized products are made specifically for the customer, returns or exchanges may not be accepted simply because the customer changes their mind or no longer wants the product.
If you receive a product that is defective, damaged, incorrect, or materially different from the approved order, please contact AKSTARCO promptly with details and, where appropriate, photographs of the issue.
AKSTARCO will review the situation and may, where appropriate, offer a replacement, correction, credit, refund, or other reasonable resolution.
Nothing in these Terms is intended to limit any rights or remedies that cannot legally be excluded under applicable law.
9. Production Times
Estimated production times will depend on the product, order quantity, customization requirements, availability of materials, design approval, and other circumstances.
Rush orders may be available subject to AKSTARCO’s capacity and may involve additional charges.
Production estimates are not guaranteed delivery dates unless AKSTARCO expressly confirms a specific guaranteed date in writing.
10. Delivery and Pickup
AKSTARCO is based in Durham Region, Ontario.
Free home delivery and pickup may be available within AKSTARCO’s applicable service area, currently intended to cover a 20-kilometre radius, subject to confirmation at the time of order.
Delivery availability, timing, and arrangements may vary depending on the order and location.
Customers are responsible for providing accurate delivery information and being available to receive their order when required.
Additional delivery charges may apply outside the applicable free-delivery area.
11. Inspection Upon Receipt
Customers should inspect their products as soon as reasonably possible after delivery or pickup.
If there is an issue with an order, customers should contact AKSTARCO promptly and provide the order details and supporting information requested.
12. Product Care
Personalized products may require specific care to maintain their appearance and durability.
AKSTARCO may provide care instructions appropriate to the product.
Customers are responsible for following applicable care instructions. Damage caused by improper washing, heating, cleaning, handling, storage, or other misuse may not be considered a manufacturing defect.
13. Intellectual Property
AKSTARCO’s original designs, graphics, logos, website content, photographs, branding, text, and other original materials remain the property of AKSTARCO or their respective rights holders unless otherwise stated.
Customers retain ownership of materials they provide to AKSTARCO, subject to the rights necessary for AKSTARCO to complete the requested order.
Customers grant AKSTARCO permission to use customer-provided materials solely as reasonably necessary to design, produce, fulfill, and provide the requested product or service.
14. Website Content
AKSTARCO makes reasonable efforts to ensure that website descriptions, product information, photographs, prices, and other content are accurate.
However, product colours, appearance, availability, specifications, and other details may change without notice.
AKSTARCO reserves the right to correct errors, update information, discontinue products, or change pricing where appropriate.
15. Website Use
You agree not to misuse the AKSTARCO website, including attempting to:
Gain unauthorized access to the website or its systems
Interfere with website operation
Upload malicious software or harmful content
Use the website for unlawful purposes
Copy or misuse AKSTARCO’s protected content without permission
Submit false or misleading information

AKSTARCO will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including severe weather, transportation disruptions, supplier delays, equipment failure, power outages, natural disasters, government actions, or other unforeseen circumstances.
Where reasonably possible, AKSTARCO will communicate significant delays and work with customers toward an appropriate solution.
19. Privacy
Your use of the AKSTARCO website and services is also subject to our Privacy Policy, which explains how we collect, use, and protect personal information.
20. Changes to These Terms
AKSTARCO may update these Terms from time to time.
Updated Terms will be posted on the website with a revised Effective Date. Your continued use of the website or placement of orders after changes are posted may constitute acceptance of the updated Terms, subject to applicable law.

These Terms are intended to be governed by the laws applicable in the Province of Ontario and the applicable laws of Canada.
